Terms of Purchase

These Terms of Purchase ("Terms") apply to all purchases made through Euda, operated by Giftivest LTD (Company Number 16197030, registered in England and Wales, with registered office at 128 City Road, London, EC1V 2NX, United Kingdom) (referred to herein as "Euda", "we", "our", "us").

By making a purchase on our platform, you agree to these Terms, our Terms of Use, Privacy Policy and Cookies Policy. Please read them carefully before ordering. In the event that there is any conflict between these Terms and our Terms of Use, the Terms of Use shall prevail. Defined terms used in these Terms but not defined herein shall have the definition applied to them in the Terms of Use.

1. Eligibility

Purchases may only be made by individuals aged 18 or over.

By placing an order, you confirm that you meet this requirement and have legal capacity to enter into a binding contract.

2. Our Products

Euda provides an investment gifting platform, offering products including (but not limited to) precious metals such as gold and silver.

Products may include digital gifting confirmations and, where applicable, physical delivery of Assets.

Images and descriptions are for guidance only. We make reasonable efforts to ensure accuracy but cannot guarantee exact representation (e.g., colour, size variations).

3. Order Process

Orders are placed via our website https://www.gifteuda.com.

After submitting your order, you will receive a confirmation email acknowledging receipt. This does not mean your order is accepted.

Acceptance occurs when we send a dispatch/shipping confirmation or when digital product delivery begins.

We reserve the right to refuse or cancel orders where:

  • Payment is not authorised or is suspected of fraud;
  • There are errors in pricing or product description;
  • The order breaches these Terms or our Terms of Use.

4. Pricing and Payment

All prices are shown in GBP (£) and include applicable taxes (unless otherwise stated).

We accept payment via Shopify Payments (Stripe), PayPal, Apple Pay, Google Pay.

You authorise us to charge the payment method provided at checkout for the full order amount.

5. Delivery

Digital products (gift confirmations, ownership records) are delivered electronically after payment.

Physical products (precious metals) will be delivered to the recipient's address provided during checkout, using approved logistics providers (Royal Mail, DPD).

Delivery times may vary depending on location and product availability. We are not liable for delays caused by third-party carriers.

6. Refunds and Returns

6.1. Gifting Service Refund Policy

The Gifting Service includes the bespoke Euda gift box, all internal packaging, and the QR code-enabled digital experience. This component of the service is governed by its own refund policy.

Refund Policy: If any component of the Gifting Service is faulty or not as described, you are entitled to a refund of the Gifting Service Fee (currently £9.99 but subject to change).

Refunds for the Gifting Service are solely applicable to significant physical damage to the Gift Box (e.g., crushed corners, deep tears)

Refund Process - To initiate a refund for the Gifting Service you must:

  • Contact our Customer Service team via email at info@gifteuda.com within 14 days of purchase.
  • Provide your order number and clear photographic evidence of the fault.
  • There is no need to physically return the box or packaging.
  • Upon verification of the fault, we will process a full refund of the Gifting Service Fee to your original payment method.

PLEASE NOTE: We do not provide refunds for a non-functions QR Code. If the QR Code does not work, please contact info@gifteuda.com, quoting your order number in the subject line, and a member of our team will respond to assist you.

6.2. Asset Service Refund Policy

This policy refers exclusively to the Asset itself, which is separate from the Gifting Service.

Refund Policy: As per the Consumer Contracts Regulations 2013, we do not accept returns or offer refunds for the Asset due to market price fluctuations or a "change of mind." Returns are only accepted in situations involving serious and material damage that affects the integrity and value of the Asset itself.

Covered Damages - Refunds or replacements are applicable for:

  • A deep scratch, crack, or dent on the Asset itself (not the protective casing).
  • Material damage affecting the integrity of the Asset.
  • Evidence of incorrect weight or purity as per the assay certificate.

Secure Return Process - To initiate a return, you must:

  • Contact our Customer Service team via email at info@gifteuda.com within 14 days of delivery with your order number and high-quality photographic evidence of the material damage.
  • If the claim is deemed potentially valid upon initial review, our team will provide a pre-paid, fully insured, tracked shipping label (e.g., via Royal Mail Special Delivery).
  • The item must be securely returned using the label provided by us. Upon our secure receipt and inspection, if the serious and material damage is verified, we will process a replacement or a full refund.

6.3 Your Statutory Rights

Nothing in this refund policy is intended to limit your statutory rights under the Consumer Rights Act 2015. For the avoidance of doubt, you have the following statutory rights:

  • 30-Day Right to Reject: If an Asset is not of satisfactory quality, fit for purposes or as described within 30 days of delivery, you have the right to reject it and claim a full refund.
  • Beyond 30 Days (Up to 6 Months): If a fault appears after 30 days but within six months, we have the right to choose to first offer a repair or replacement. If this is not possible, or is unsuccessful, you are entitled to a refund.
  • After 6 Months: You may request repair, replacement, or partial refund, but you may need to provide evidence that the product was defective at delivery.

7. Prohibited Use

You may not use our Services or Assets for:

  • Fraud, money laundering, or financial crime.
  • Harassment, hate speech, or illegal activity.
  • Spam, data scraping, or reverse engineering.
  • Distribution of malware, viruses, or harmful code.
  • Circumventing platform security.
  • Unauthorised resale or commercial exploitation.

8. Account and Recipient Data

You may need to create an account to purchase or manage gifts.

You are responsible for ensuring recipient information (name, address, phone, email) is accurate.

We process recipient data solely for delivery purposes. Recipients may exercise data rights as set out in our Privacy Policy.

9. Risk and Ownership

Ownership of physical goods (such as gold and silver) passes to the Recipient upon successful delivery to the delivery address provided by the Customer.

Risk of loss or damage to physical goods passes upon delivery to the Recipient address.

For digital goods (such as gift confirmations, digital certificates, or access credentials), access rights are personal, non-transferable, and limited to personal use by the intended recipient.

11. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may, solely at our own discretion, require mediation or arbitration before litigation in certain cases.
